These scenarios cover a range of examples to help providers understand issues around the use of physical and chemical restraint. They are intended to be illustrative only, and should not be relied upon as authority.

Providers should be mindful of their obligations under the Quality of Care Principles 2014, and pay careful attention to the legislative requirements underpinning the use of restraint when applying those obligations to real-life situations. Further information on provider obligations can be found in this document.

Open disclosure is the open discussion that an aged care provider has with people receiving aged care services when something goes wrong that has harmed or had the potential to cause harm to a person receiving aged care service. With more than 1.3 million people receiving care in Australia, this is a crucial activity for providers to support continuous improvement within their service.

The Commissioner may make any arrangements as are necessary for the purposes of completing the activities. The Rules provide for processes commenced before 1 January 2019 to continue to be progressed as if the steps had been taken under the Rules. This includes applications for re-accreditation, quality reviews and monitoring processes.
