Serious risk decisions
The Department of Health’s aged care regulatory functions have been transferred to the Aged Care Quality and Safety Commissioner. As these take effect from 1 January 2020, the content on this page is currently undergoing review. For a summary of key changes, please click here.
The Aged Care Quality and Safety Commission (Commission) monitors the quality of care and services provided by providers of residential services, home services and National Aboriginal and Torres Strait Islander Flexible Aged Care Program services against the Aged Care Quality Standards (Quality Standards).
Following a performance assessment, a decision is made about whether the provider has complied with the Quality Standards. If a decision is made that a provider has failed to comply with the Quality Standards, the Commission must then decide whether that failure has placed or may place, the safety, health or well-being of an aged care consumer of that service at serious risk.
If a serious risk decision is made, the provider is notified of the failure, the area of serious risk and the timetable it has to make the improvements required to return to compliance. The Department of Health is also notified.
The Commission publishes all serious risk decisions made from 1 July 2019 resulting from non-compliance against the Quality Standards for residential services and home services.
Serious risk decisions made during each month are published in a register at the end of that month and will include:
- the name and Commission identifier of the service;
- the name of the provider of the service;
- the date the serious risk decision was made; and
- the specific Quality Standard(s) in which serious risk was found.
For example, if a serious risk decision is made in a particular month, information about that serious risk decision will generally appear in that month’s register, which will be published shortly after the end of the month. The register will then be archived on the Commission’s website when the next month’s register is published.
