Aged care laws in Australia have now changed. The new Aged Care Act 2024 and Aged Care Rules 2025 now apply. While we complete updating of our website, including draft guidance and other materials, to align with the new laws, providers are advised to refer to the new Act and Rules for any required clarification of their obligations and legal responsibilities. Request reconsideration of a reviewable decision

Some of our decisions are reviewable decisions. You can ask us to reconsider the following types of reviewable decisions related to provider registration:

  • initial registration decisions including registration categories and approved residential care home
  • renewal of registration including registration categories
  • approval of residential care homes
  • variation to registration
  • suspension or revocation (cancellation) of registration
  • conditions imposed on registration including determinations relating to the governance conditions.

Once you’ve downloaded and completed the form, you must submit it to us within 28 days of us notifying you of our original decision.

We must make a reconsideration decision within 90 days of receiving your reconsideration request. The reconsideration decision will be either to:

  • affirm the reviewable decision
  • vary the reviewable decision
  • set aside the reviewable decision and substitute a new decision.

Withdrawing your request for reconsideration

If you’ve made a request for us to reconsider a reviewable decision, you can withdraw the request at any time before we make a decision on the request.

To withdraw your request, send an email to reconsideration@agedcarequality.gov.au.
