Aged care laws in Australia have now changed. The new Aged Care Act 2024 and Aged Care Rules 2025 now apply. While we complete updating of our website, including draft guidance and other materials, to align with the new laws, providers are advised to refer to the new Act and Rules for any required clarification of their obligations and legal responsibilities. Consultation now open - draft Regulatory Strategy 2025-26

We’re updating our Regulatory Strategy for 2025-26 and are inviting your feedback.

Your feedback will help us to ensure that the strategy is easy to understand, practical and supports the delivery of high quality and safe aged care.

This updated strategy outlines how we will uphold the rights of older people, support providers and workers to meet their obligations, and take proportionate, risk-based action where issues arise; all in preparation for the new Aged Care Act, commencing 1 November 2025.

The revised strategy sets out how we will:

  • uphold the rights of older people under the Statement of Rights
  • support providers, responsible persons, aged care workers and digital platforms uphold these rights, and comply with their obligations
  • ensure provision of safe, accessible complaints mechanisms for supporting older people
  • engage and educate the sector
  • regulate providers through registration and monitor workers, working with them to bring them back to compliance when needed
  • uphold whistleblower protections for people to make complaints and give feedback without reprisal
  • respond proportionately to risk
  • support a sustainable, innovative and continuously improving aged care sector.
