
Older people now have stronger rights and protections following recent changes to aged care laws in Australia. These changes include a Statement of Rights, which explains that older people accessing aged care services can:
- make their own decisions about their own life
- have their decisions respected
- get information and support to help make their own decisions
- communicate their wishes, needs and preferences
- feel safe and respected
- have their culture and identity respected
- stay connected to family and community.
Statement of Rights
The Statement of Rights recognises that you are your own person, and your preferences and needs are unique to you. Watch the video below for an overview of the Statement of Rights and what it means for older people.
Everyone’s situation in aged care is different but it’s important to know you have a voice and should be listened to. Some practical examples of your provider following the Statement of Rights when delivering your aged care include:
- giving you easy to understand information about your care
- supporting your preferences for your daily routine
- seeking, listening and responding to your feedback and concerns
- making sure you can access the things you need
- making sure you are only taking the medicines you need and have been prescribed to you
- providing food and drink options that you like
- keeping you connected to your family, community, pets, culture and country.
Speaking up is your right
If you feel that your rights are not being respected, or you’re unsure about something to do with your care, you can speak up. It’s your right.
Your provider must have a complaints process that is easy to understand and use. They should provide you with information about how you can give feedback about your care. If you don’t feel comfortable talking to your provider or if speaking to your provider hasn’t helped, you can speak with us.
You can also contact the Older Persons Advocacy Network (OPAN). If you require information or support with government-funded aged care services, OPAN’s Aged Care Advocacy Line can provide free, confidential, and independent support. Supporting First Nations and Culturally and Linguistically Diverse older people
We recognise that older people for diverse cultural, linguistic and life backgrounds may have very unique needs and preferences.
Their background and experience impacts on how they access and engage with aged care supports. This includes differences in language, traditions, identity and family structures.
We are committed to making sure our information is inclusive, culturally safe and responsive. Every older person should feel safe, understood, respected and able to make choices that reflect who they are.
