Aged care laws in Australia have now changed. The new Aged Care Act 2024 and Aged Care Rules 2025 now apply. While we complete updating of our website, including draft guidance and other materials, to align with the new laws, providers are advised to refer to the new Act and Rules for any required clarification of their obligations and legal responsibilities. Requirements relating to compliance with the Code of Conduct will continue after Transition Day.

Where a worker or responsible person is subject to a requirement relating to compliance with the Code of Conduct given under the old law, the requirement will continue after Transition Day. ​

These requirements only continue to apply if the provider for whom the aged care worker and/or responsible person is or was working is deemed a registered provider on Transition Day.​

Where we have required a worker or responsible person to do something related to compliance with the Code of Conduct before Transition Day, and the action has not been completed, the requirement will continue, and you will need to undertake those actions.  

Where a worker or responsible person does not comply with the requirement, the Commission may exercise its information gathering or monitoring powers to find if the Code of Conduct is being complied with. If we find the Code of Conduct is not complied with, we might take actions against aged care workers or responsible persons as a result of the information obtained.
