This section provides information about aged care service providers' performance relating to their responsibilities under the Aged Care Quality and Safety Commission Act 2018 and the Aged Care Act 1997, or the Commonwealth funding agreement that relates to a service.
The information published covers all service types including residential services, home services and National Aboriginal and Torres Strait Islander Flexible Aged Care Program services.

Non-compliance
Here you can access a register of non-compliance determined by the Commission. The register includes information on non-compliance with a provider’s responsibilities under the Aged Care Act 1997, the Aged Care Principles or its Commonwealth funding agreement and any subsequent regulatory action taken by the Commission.
The non-compliance tracker on the My Aged Care website has details of non-compliance notices, notices of requirement to agree to certain matters (notices to agree) and sanctions issued to providers.
Regulatory decisions
As the national aged care regulator, part of the Commission’s role is to:
- assess the performance of providers against the Aged Care Quality Standards
- take action if a provider isn’t complying with their legal responsibilities or if there are concerns about risk to consumers
- resolve complaints about services.
We must ensure that our procedures and decisions are fair and appropriate.

Enforceable Undertaking
If the Commission and a provider reach agreement on a specified course of action to address any noncompliance, the Commission may accept an enforceable undertaking from the provider. The undertaking may indicate that a provider will take action to comply with its responsibilities under the Aged Care Act, or it will refrain from a specific action or it will take action to ensure that it does not contravene its responsibilities under the Aged Care Act.

Serious risk decisions (archive)
Prior to 1 January 2020, the Commission published all serious risk decisions made from 1 July 2019 resulting from non-compliance against the Quality Standards for residential services and home services.
